Who is a Refugee?
The 1951 UN Refugee Convention says that a refugee is a person
who:
- is outside their home country
- is afraid to return to their home country,
- can prove they have very good reasons to be afraid that they
will be harmed if they do return
- can prove the harm they are afraid of is so severe it amounts
to persecution. Persecution is defined generally as a threat to
life, safety or physical freedom that is inflicted offensively
or unlawfully. Severe discrimination that threatens a person's
survival may also be persecution. For refugees and asylum-seekers,
the persecution must be greater than what everyone in the applicants'
home country experiences.
- fears persecution because of their:
- race
- religion
- nationality
- being a member of a particular social group
- political opinion
- is not protected by their own government in his/her home country
