Who is a Refugee?

The 1951 UN Refugee Convention says that a refugee is a person who:

  • is outside their home country
  • is afraid to return to their home country,
  • can prove they have very good reasons to be afraid that they will be harmed if they do return
  • can prove the harm they are afraid of is so severe it amounts to persecution. Persecution is defined generally as a threat to life, safety or physical freedom that is inflicted offensively or unlawfully. Severe discrimination that threatens a person's survival may also be persecution. For refugees and asylum-seekers, the persecution must be greater than what everyone in the applicants' home country experiences.
  • fears persecution because of their:
    • race
    • religion
    • nationality
    • being a member of a particular social group
    • political opinion
  • is not protected by their own government in his/her home country
