Temporary Protection Visa (Subclass 785)
This 3-year temporary visa gives the visa holder
the right to work, to Special Benefits payments and access to Medicare.
It does not give the right to family reunion or to return to Australia
if he/she leaves.
This is a visa for people who:
- are found to be refugees by the Australian Government
- meet health and character
requirements
TPV holders may make a separate application for a permanent Protection
Visa.
The permanent protection visa can be granted only if Australia continues
to owe protection obligations to the applicant and the applicant
has been a TPV holder for at least 30 months, unless the Minister
waives this 30 months period.
Note that if the applicant
- had stayed for 7 days or more in a country other than Australia,
and could have obtained protection from that country, or from
the UNHCR office in that country, and
- arrived in Australia AFTER 27 September 2001
or lodged a further protection visa application after that date,
then this person cannot be granted a permanent
Protection Visa.
Such a person may only apply for a further TPV, or if eligible,
one of the mainstream visas for which TPV holders are eligible.

Protection (Class XA) visa, is not available electronically, but
can be obtained from
any DIMA office, or if a person is in immigration detention, by
asking a
departmental officer.
