My Visa Application was Rejected

If you have applied for a visa to Australia and your application was rejected by the Department of Immigration and Multicultural Affairs, and you or your sponsor/proposer are in Australia at the time of rejection, you may have the right to a merits review by an appropriate tribunal. The idea of migration review is to examine the validity of decisions made by DIMIA delegates regarding your visa application.

There are three tribunals in Australia that deal with these kinds of appeals:

Refugee Review Tribunal (RRT)
Migration Review Tribunal (MRT)
Administrative Appeals Tribunal (AAT)

Which tribunal will deal with your appeal depends on what kind of visa you were denied and what were the reasons for DIMIA’s rejection.

• RRT will deal with your appeal if you applied for an onshore Protection Visa provided it was NOT rejected on character grounds. To learn more about appealing to RRT click here.

• MRT will deal with your appeal if you applied for any kind of Family Migration Visa and you (or your sponsor/proposer) are in Australia at the time of rejection. However, if your visa was rejected on character grounds, MRT will not deal with your appeal. To learn more about appealing to MRT click here.

• If you have applied for any visa and it has been rejected on character grounds, and either you or your sponsor/proposer are in Australia at the time of rejection, you need to lodge your appeal with the AAT. To learn more about appealing to AAT click here.
