I was granted a refugee or humanitarian visa and want to bring my family to Australia

Who can bring immediate family to Australia?

If you:

  • have any one of these refugee or humanitarian visas, - subclass 866, 200, 201, 202, 203,
    or 204 - (check the number that is written on your visa), and

  • got your visa less than 5 years ago and

  • told Immigration when applying for your refugee visa that the person you want to bring to
    Australia was a member of your immediate family.
then you can propose your immediate family whether they are in their country of origin or outside
of it, under the Split family program.

If you are not sure whether you told DIMA all the names of your immediate family then you can
ask for copies of all the forms and information that you gave to the Australian Embassy or
High Commission before you came to Australia. Download and fill in Form 424 Freedom of Information Request. You will need the Adobe Reader, version 4 or later, on your computer.

Make sure you read the instructions on the Form very carefully and that you attach certified copies
of your Identification Documents to the Form (passport, driving license, travel document, etc.).

Send the completed form to the nearest DIMA office. DIMA will then send you copies of all these documents, and you can check if you told them about the the members of your immediate family.

Make copies of the documents and send them with your application form to prove you did tell them
about your immediate family.

 

What do I need to propose my immediate family?

If you are eligible for the Split Family porgram, you will need to download two forms from DIMA website, or obtain them by going to the nearest DIMA office. These forms are:

  • Refugee and Special Humanitarian Proposal (Form 681) This form should be used by you as the proposer. To be eligible to propose as an individual, you must be either an Australian citizen; or a permanent resident of Australia; or an eligible New Zealand citizen.

  • Application for an offshore humanitarian visa (Form 842). This form must be completed
    and signed by the applicant(s). Please read the instructions on the form carefully and make
    sure you attach all the necessary documents (see last page of the form for the checklist).
    You also need to check with DIMA where to send the forms as certain applications MUST be lodged in Australia.

What if the Split Family Program doesn't apply to me?

Your family members may still be able to come to Australia under the offshore refugee program or
the Family Migration Program. You should get legal advice about which visa to apply for.
